It is the 11th of May 2018 and Bal Gangadhar Tilak, or the Bal in Lal Bal Pal trio was ‘the father of terrorism’, you don’t believe us you might as well read the Class 8 reference book in Rajasthan, which turned out a poor phraseology. It is such phrases that then get mentioned by the great leader and his followers which become truths like Nehru never went to visit Bhagat Singh in jail.
Yesterday marked the end of two crucial tests for Indians. One being Karnataka where the never-ending campaigning came to an end and the other being the hearing on Aadhaar.
“Dhool chehre pe thi, aur aaina saaf Karta Raha”.
(The dust was on my face, and I kept wiping the mirror)
Let’s start with what that monstrosity and inhumanity wrapped under the garb of Aadhaar. Oh and did we mention UNCONSTITUTIONAL. Well, for all who have been listening for long, you’d know our position onAadhar, it is quite simple #Destroy The Aadhaar. Now the outcome of the verdict will define the relationship between the State and the citizens, amidst growing privacy and security concerns all eyes are on the SC Bench.
Wrapping up a marathon hearing that lasted 38 working days spread over four months, making it the second longest oral hearing in Indian judicial history the Supreme Court yesterday reserved its verdict on a clutch of petitions challenging the Constitutional validity of the 2016 Aadhaar Act.
Referring to the government citing black money and terrorism to justify Aadhaar, Senior Advocate Arvind Datar quoted Mirza Ghalib: “Dhool chehre pe thi, aur aaina saaf karta raha”. (The dust was on my face, and I kept wiping the mirror).
The decision to tag the Aadhaar law as a money bill has “serious implications” as one half of the Parliament was disabled from making any amendment, the Supreme Court was told.
“The implications of passing a non-money bill as a money bill are very serious. One half of the Parliament is virtually disabled from making any amendments. It even denuded the highest constitutional authority of the country, the President of India, of his powers,” he said.
Chidambaram also referred to section 57 of the Aadhaar Act and said it empowered any private corporate body to use Aadhaar data for authentication and this has nothing to do with the constitutional scheme dealing with a Money Bill.
He sought setting aside of the Aadhaar law and said Parliament be allowed to have a re-look on it.
While the verdict has been reserved a great thanks goes out to several people who took the fight to the court , the petitioners and the advocates and the myriad people working along with them whose legal arguments and verbal sophistry threw more insights and made a case for destroying the Aadhaar.
Senior Advs and their teams: Shyam Divan, Kapil Sibal, Gopal Subramanium, P Chidambaram, Arvind Datar, and then there were people who ensured the legalese simplified the arugments for those who find it difficult to go past legal sophistry, like Gautam Bhatia, Prasanna and Apar Gupta.
KARNATAKA CAMPAIGN ENDS, RACE FOR PRIME MINISTERSHIP BEGINS
And on to the other big thing that came to an end, the Karnataka Election Camapign. Everyone is staking claims to form a majority government, it will be interesting to see if Siddharamaiah can buck the Karnataka trend, will Khagre come out and lead a coalition, and who will HD Devegowda side with or will Bellary buying power ensure Yedyurappa will lead North Karnataka and make sit atop the throne again.
All eyes are now on 15th of May, that is just 4 days away for the nation to know which side are the wind blowing or will India face a Modi Deluge.
Its not just about the CM. Closely linked to it is also the race for Prime Ministership. The day before it was Rahul Gandhi coming out and showing he also wants to contend for the job, Yesterday there was a media burst of Telanagana CM, and today it is the Didi for PM page, Ebar Benagli PM. A Facebook page set up by Mamata fans (read TMC supporters) set up a FB page,
“Chalo Bodlai-Ebar Bangali Prodhanmantri Chai” (Come let’s bring a change — This time we need a Bengali PM).
Wonder where Mayawati is? And what of Arvind Kejriwal, the self styled political god of aam aadmi.
KEJRIWAL RELATIVE ARRESTED IN PWD SCAM, FAINTS IN COURT
Chief Minister Arvind Kejriwal’s relative Vinay Bansal, arrested in connection with an alleged scam in the Public Works Department (PWD), was on Thursday remanded in one-day judicial custody by a Delhi court which refused the Anti-Corruption Branch’s plea seeking three-day police custody after he fainted before it.
Duty Metropolitan Magistrate Neeti Suri Mishra rejected the ACB’s application for three-day police remand of Bansal, saying he was not medically fit.
FLYOVER READY BUT PM NOT READY
And for Delhiites your wait to have an expressway may be finally over by the end of this month. The apex court took exception to the 135-km Expressway, which envisages signal-free connectivity between Ghaziabad, Faridabad, Gautam Budh Nagar (Greater Noida) and Palwal, not being thrown open to the public despite being ready. And why hasn’t it been opened yet? Well because the PM who works 18 hours a day has been very busy. Busy with, well 20 election rallies in Karnataka for one. It took the SC to remind the Centre of leadership duties beyond perpetually campaigning. The judges made it clear that if the Eastern Peripheral Expressway was not inaugurated on or before May 31, it would be thrown open for public use on June 1.
